Ranier Rec LLC dba Side Out Pickleball Centers
I understand and acknowledge that participation in recreational and athletic activities—including but not limited to pickleball play, open play, clinics, leagues, tournaments, lessons, camps, private events, and related physical or spectator involvement—carries inherent risks. These include, but are not limited to, slips, falls, physical contact with other players, equipment malfunction, lighting effects, or facility-related hazards, which could result in minor or serious injury, paralysis, property damage, or even death.
I understand that such risks may arise from my own actions, inactions, or negligence, as well as the actions, inactions, or negligence of others, including Side Out staff, other participants, or third parties. Despite these risks, I voluntarily choose to participate and permit the Participants in my care to do so as well.
I affirm that I and the Participants are in good health, physically capable of safely participating in the Facility’s activities, and not under the influence of alcohol, illicit substances, or medication that would impair ability or judgment. I affirm that no healthcare provider has advised me or the Participants to refrain from such physical activity. I am solely responsible for determining the readiness and fitness of the Participants to engage in any activity at the Facility.
To the fullest extent permitted by law, I hereby voluntarily release, waive, and discharge Ranier Rec LLC, its owners, officers, employees, contractors, affiliates, agents, sponsors, insurers, landlords, and equipment suppliers (collectively, the “Released Parties”) from any and all claims for damages, injury, disability, death, or property loss arising from participation in activities at the Facility—whether such claims arise from negligence or otherwise.
This release applies to any incident occurring on or off the premises, during or related to participation in Side Out activities, including off-site events sponsored or hosted by the Facility.
I agree to defend, indemnify, and hold harmless the Released Parties from any and all claims, liabilities, demands, causes of action, and expenses (including legal fees) resulting from or arising in connection with participation by me or the Participants in any Facility activities or use of the Facility.
This includes claims brought by third parties arising out of my or the Participants’ conduct, as well as any claim brought by a Participant against the Released Parties.
I acknowledge that Side Out is not responsible for lost, stolen, or damaged personal items, including items left in lockers, vehicles, or anywhere else on the premises.
This Release shall be effective immediately and remain in full force indefinitely for all present and future visits or participation by me or the Participants in any activities offered by Side Out, at this or any future locations operated by Ranier Rec LLC.
This Release shall be binding on my heirs, executors, legal representatives, assigns, and successors in interest.
If any portion of this Release is found to be invalid or unenforceable, the remainder shall continue in full legal force and effect. This Release is governed by the laws of the State of Washington.
BY SIGNING BELOW, I certify that I am at least 18 years of age and legally authorized to sign this agreement for myself and/or as a parent or legal guardian for any minors listed. I acknowledge that I have read and fully understood the contents of this Release, and I voluntarily agree to its terms, fully aware of the legal consequences of doing so.
