Side Out Pickleball Centers – Membership Terms and Conditions

Operated by Ranier Rec LLC dba Side Out Pickleball Centers

By enrolling in a membership with Side Out Pickleball Centers, operated by Ranier Rec LLC (“Side Out,” “we,” “our,” or “us”), you (“you,” “your,” or “Member”) agree to the following Membership Terms and Conditions (the “Agreement”), which govern your membership, participation in programs, events, and access to Side Out facilities and services.

1. Agreement Structure

Your Membership Agreement with Side Out consists of:
– The Membership Application, including your selected membership plan and payment information
– This Agreement
– The Liability Waiver and Release (required for participation)
These documents together constitute the full agreement between you and Side Out regarding membership.

2. Club-Specific Membership

All memberships are tied to a specific Side Out location and are non-transferable between clubs unless otherwise stated.

3. Membership Types

Memberships are offered as:
– Monthly (Month-to-Month)
– Annual (12-Month Commitment)
Your selected plan will begin on your Membership Start Date and renew automatically unless cancelled.

4. Start Date and Renewal

Membership begins on either (a) the date of purchase or (b) the official opening date of your selected Side Out facility, if not yet operational. Monthly Plans renew every 30 days; Annual Plans renew every 12 months.

5. Automatic Renewal and Cancellation

  1. Monthly Plan: Cancel within 48 hours for a full refund. Otherwise, 20 days’ notice is required.
    b. Annual Plan: Cancel within 7 days for a full refund. Non-refundable afterward.
    c. Club Rights: We may suspend or cancel memberships at our discretion.

6. Member Responsibilities

You agree to maintain a valid payment method, keep your information updated, authorize recurring billing, and not dispute valid charges.

7. Refunds and Payments

Membership fees are non-refundable after the cancellation window. No credits for partial use.

8. Eligibility and Waiver Requirements

You must sign and renew a Liability Waiver annually and provide photo ID and a current photo. Memberships are not valid for private or commercial use.

9. Suspension or Termination by Side Out

We may suspend or terminate memberships for violations of rules or inappropriate conduct.

10. Membership Upgrades

Members may upgrade to a higher-tier plan by paying the rate difference. Downgrades are not allowed mid-cycle.

11. Contact Information Updates

Members must keep their contact and billing information current.

12. Privacy

Our practices are outlined in our Privacy Policy. By joining, you consent to our data usage practices.

13. Limitations and Availability

Membership does not guarantee court availability. Reservations may be required, and access to special events may be limited.

14. Policy Changes

We may update these terms or offerings at any time. Significant changes will be communicated via email or Club posting.

15. Taxes

Members are responsible for all applicable taxes.

16. Assumption of Risk and Release

Members accept inherent risks of athletic participation and release Side Out from liability. Members agree to indemnify Side Out.

17. Disclaimer of Warranties

Membership is provided “as is” with no warranties of fitness or merchantability.

18. Limitation of Liability

Side Out’s liability is limited to fees paid in the last 3 months or $100, whichever is greater.

19. Statute of Limitations

By participating in the Plan, you waive all rights to bring any claim or action related to your participation in the Plan in any forum beyond one year after the first occurrence of the act, event, condition, or omission upon which the claim or action is based.

20. Arbitration and Dispute Resolution

All disputes will be resolved through binding arbitration on an individual basis. No class actions allowed.

21. Governing Law

This Agreement is governed by the laws of the State of Washington or the location where your Club operates.

22. Severability

If any part of this Agreement is invalid, the remainder will still apply.

23. No Waiver

Side Out’s failure to enforce a provision is not a waiver of future enforcement.
